The Montenegrin Agency for Protection of Competition has announced an important decision finding a violation of the Law on Protection of Competition. Below is a summary of the most important positions taken by the Agency in this case:
In its decision, the Agency found that the companies “INA – CRNA GORA” LLC BUSINESS COMPANY FOR PRODUCTION, TRADE AND SERVICES PODGORICA and “JUGOPETROL” JOINT STOCK COMPANY FOR EXPLORATION, EXPLOITATION, AND TRADE OF OIL AND PETROLEUM PRODUCTS – PODGORICA, from 8 July 2019, to 31 December 2019, applied a concerted practice of fixed retail prices of liquid petroleum gas on the retail market of liquid petroleum gas in the territory of Montenegro. This agreement aimed at or had the effect of preventing, limiting, or distorting competition, which is contrary to Article 8 of the Law on Protection of Competition.
Sanctions:
The agreement has been declared PROHIBITED AND VOID and the Agency has instructed both companies to cease further implementation and enforcement of the prohibited agreement.
Additionally, the Agency has ordered these companies to submit annual reports to the Agency on the movement of the total quantities of liquid petroleum gas purchased and sold in the previous year, as well as their value.
