On July 26, the National Assembly of Serbia adopted the Law on Amendments to the Law on Planning and Construction (Zakon o izmenama i dopunama Zakona o planiranju i izgradnji “Official Gazette of RS”, No. 62/2023).
The new Law provides the abolition of the special law (lex specialis) on conversion. More precisely, the Law on Converting the Right of Use into the Right of Ownership on Construction Land for a Fee.
Key Novelties
One of the many novelties introduced by this Law is the introduction of the obligation that all buildings, regardless of age, must also have an energy passport. In this regard, the obligation to attach the Certificate on the energy properties of buildings when concluding sales contracts is also a novelty. It is envisaged that the owners of all existing buildings will have a period of 10 years to obtain a certificate on the energy properties of the building.
Perhaps the most significant amendment and positive solution is the introduction and definition of the concepts of green construction, certification of buildings, electromobility and other elements of the green agenda. Benefits are foreseen for investors of buildings for which a green building certificate has been issued in the form of a 10% reduction on the amount of the fee for the development of construction land.
