On September 28, 2023, the Government of the Republic of Serbia adopted the Regulation on the Terms of Delivery and Supply of Electrical Energy (hereinafter referred to as the “Regulation”). This Regulation was published in the Official Gazette on October 5, 2023, and it will come into effect on October 13, 2023, the eighth day from the date of publication.
The purpose of the new Regulation, among other things, is to provide more detailed rules regarding the conditions for obtaining approval for connection to the transmission and distribution systems. This includes comprehensive provisions for the mandatory preparation of a connection study for the transmission system and the part of the distribution system managed by the transmission system operator (hereinafter referred to as the “Study”). It also establishes the requirement to submit evidence of depositing funds for the cost of preparing the Study or providing a bank guarantee in favor of the transmission system operator.
The most significant amendments introduced by this Regulation are:
1. Deadlines for submitting requests for the preparation and the actual preparation of the connection Study
2. Depositing funds for the preparation of the connection Study
3. The obligation to provide a bank guarantee to the transmission system operator
4. The connection Study and the deposited funds required when connecting facilities for electricity production and storage to the distribution system
Application: The provisions of the new Regulation will apply to ongoing procedures for concluding agreements on the preparation of connection studies for the transmission system or distribution system that have not been concluded by the date of the entry into force of this Regulation.
