Serbia: The Regulation on the Application of Deadlines During the State of Emergency

The Regulation on the Application of Deadlines During the State of Emergency (Uredba o primeni rokova za vreme vanrednog stanja, Official Gazette of the RS, no. 41/20) provides that, during the state of emergency, the parties to proceedings before the authorities shall not bear the consequences of their failure to comply with the deadlines prescribed by the laws governing the general administrative procedure or special administrative procedures.

Submission of letters in the administrative procedure and notification actions, from which the deadlines begin to expire, shall be considered executed when 15 days have expired since the end of the state of emergency.

Deadlines that expire during the state of emergency, relating to taking administrative actions, terminating administrative proceedings and deciding upon legal remedies, will be considered expired when 30 days have expired since the end of the state of emergency.
